About Tax Talks

Tax Talks is a podcast and information platform published by Velocity Legal Pty Ltd ACN 614 742 246.

In this Privacy Policy, “Tax Talks”, “we”, “us” and “our” refer to Velocity Legal Pty Ltd when it operates Tax Talks. “You” refers to any individual whose personal information we collect or hold.

We understand that privacy is important. We manage personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

This Privacy Policy explains how we collect, hold, use and disclose personal information in connection with:

  • the Tax Talks website;
  • the Tax Talks podcast and related content;
  • enquiries and communications sent to Tax Talks;
  • podcast guests, contributors and collaborators;
  • Tax Talks social media accounts and distribution channels; and
  • related Tax Talks events and promotional activities.

This Privacy Policy applies to personal information that Velocity Legal collects or holds in connection with Tax Talks, including any historical Tax Talks information that Velocity Legal now lawfully holds.

A different privacy policy may apply if you contact or engage Velocity Legal for legal services. Velocity Legal’s professional and confidentiality obligations may also apply in those circumstances.

What is personal information?

Personal information means information or an opinion about an identified individual, or an individual who can reasonably be identified.

Information does not need to include a person’s name to constitute personal information. Whether information identifies someone will depend on the circumstances and the other information available.

What personal information do we collect?

The personal information we collect depends on how you interact with Tax Talks.

We may collect:

  • your name, email address, telephone number and other contact details;
  • your job title, employer, organisation and professional area;
  • information contained in an enquiry, topic suggestion, guest recommendation, feedback or other communication;
  • your communication preferences;
  • information you provide when communicating with us through email, telephone, social media or the Tax Talks website;
  • publicly available professional information about podcast guests, prospective guests and contributors;
  • guest biographies, professional experience, profile photographs and social media details;
  • audio and video recordings, photographs, transcripts, quotations and other content created in connection with Tax Talks;
  • information concerning permissions, consents and arrangements for recording, publishing and promoting podcast content;
  • technical information processed when you access the website, such as your internet protocol address, browser and device information, requested pages, access dates and times, and security-related information; and
  • any other personal information that you choose to provide to us.

Tax Talks does not ask you to provide tax file numbers, financial records, legal documents, tax advice files or other confidential professional information through its general contact form.

You should not submit confidential, privileged or highly sensitive information through the Tax Talks website.

How do we collect personal information?

We generally collect personal information directly from you when you:

  • submit a form through the Tax Talks website;
  • contact us by email, telephone or social media;
  • provide feedback;
  • suggest a topic or guest;
  • agree to participate in a podcast episode;
  • contribute information, materials or content;
  • attend a Tax Talks event or related activity; or
  • otherwise communicate or interact with us.

We may also collect personal information from:

  • a podcast guest’s employer, representative or professional adviser;
  • other podcast guests, contributors and collaborators;
  • your organisation or an organisation with which you are associated;
  • publicly available professional websites, publications, directories and social media profiles;
  • Velocity Legal personnel involved in producing or administering Tax Talks; and
  • service providers that help us operate the website and podcast.

If you give us personal information about another person, you should have authority to provide it and should make that person aware of this Privacy Policy where appropriate.

Browsing anonymously

You may generally browse the Tax Talks website and listen to publicly available content without identifying yourself to us.

Website hosting and security providers may still process limited technical information when you access the website.

We may need your name and contact details if you want us to respond to an enquiry, consider a guest proposal, arrange an interview or manage another request.

Why do we collect and use personal information?

We collect, hold, use and disclose personal information to:

  • operate, maintain and secure the Tax Talks website and podcast;
  • respond to enquiries, suggestions and feedback;
  • communicate with listeners, guests, contributors and collaborators;
  • assess proposed topics, guests and collaborations;
  • research, plan, record, edit and publish podcast episodes;
  • prepare and publish guest biographies, photographs, recordings, transcripts, quotations and related content;
  • distribute and promote Tax Talks episodes;
  • administer podcast recordings, events and other activities;

Podcast guests and contributors

If you participate in Tax Talks as a guest or contributor, we may collect and create personal information about you, including:

  • your biography, position and professional experience;
  • your photograph, voice and image;
  • recordings and transcripts of your participation;
  • statements and opinions you provide during the recording; and
  • information about the promotion and publication of the episode.

We use this information to plan, produce, publish, distribute, archive and promote the relevant episode and Tax Talks generally.

We ordinarily confirm recording and publication arrangements with guests or contributors before publication. A guest agreement, recording consent or other arrangement may also govern your participation.

Published episodes, recordings, transcripts, biographies, photographs and promotional materials may remain publicly available as part of the Tax Talks archive.

Podcast platforms, social media services, search engines and other third parties may retain copies or records of published content. We cannot always remove content from services that other organisations control.

Sensitive information

Sensitive information includes information about matters such as a person’s health, racial or ethnic origin, political opinions, religious beliefs, sexual orientation, criminal record and membership of certain associations.

Tax Talks does not generally seek to collect sensitive information through its website.

We will only collect sensitive information where:

  • it is reasonably necessary for our activities;
  • you consent to the collection; or
  • the law otherwise permits or requires it.

A guest or contributor may voluntarily discuss information of a sensitive nature during an episode. We will handle that information in accordance with the agreed recording and publication arrangements.

Website hosting and technical information

The Tax Talks website uses Webflow for website hosting and form processing.

When you access the website, Webflow and other technical service providers process limited information required to deliver, maintain and secure the website. This may include:

  • your internet protocol address;
  • your browser and device type;
  • the page or resource requested;
  • the date and time of the request;
  • basic network and diagnostic information; and
  • information used to identify malicious activity, automated submissions or security threats.

We use this information to operate the website, maintain its security, diagnose problems and process website requests.

The website also loads functional code and website assets through external content delivery networks. Those providers may receive technical request information when they deliver those resources to your device.

Cookies and tracking technologies

Tax Talks does not currently use:

  • advertising or social media pixels;
  • session replay tools;
  • cross-site behavioural tracking; or
  • technologies designed to create advertising profiles from website visits.

The website or its service providers may use technologies that are strictly necessary to provide website functions, maintain security, process forms or prevent spam.

We may introduce analytics or other website technologies in the future.

Contact forms

When you submit a form through the Tax Talks website, we collect the information that you enter into the form.

Webflow processes and stores the submission on our behalf and may send the submitted information to nominated Tax Talks or Velocity Legal email recipients.

We use the information to respond to your enquiry, consider your suggestion or request, and maintain an appropriate record of the communication.

If you do not provide the information requested by the form, we may not be able to respond or take the requested action.

The website may use security or spam-prevention services in connection with form submissions. These services may process technical information and interaction signals to distinguish genuine users from automated activity.

External podcast and social media platforms

Tax Talks publishes, distributes or promotes content through external services, which may include:

  • podcast hosting and distribution platforms;
  • Spotify;
  • Apple Podcasts;
  • YouTube;
  • LinkedIn; and
  • other social media, video or audio services.

The website may contain links to these services or may display content supplied by them.

When you follow a link, play externally hosted content or interact with an external platform, that platform may collect information about you, your device and your interaction with its service.

The relevant external platform handles that information under its own privacy policy and terms. Tax Talks does not control the privacy practices of external platforms.

You should review an external platform’s privacy policy before creating an account, providing personal information or using its services.

How do we hold personal information?

We may hold personal information in:

  • Webflow form submission records;
  • Velocity Legal’s email and information technology systems;
  • cloud storage and document management systems;
  • podcast recording, transcription and production systems;
  • communications and contact records; and
  • secure electronic or physical records.

We may combine information from related communications where this helps us respond to an enquiry, administer an episode or maintain accurate records.

Disclosure of personal information

We may disclose personal information to:

  • Tax Talks hosts and authorised Velocity Legal personnel;
  • podcast guests, contributors and collaborators where reasonably necessary;
  • Webflow as the website hosting and form-processing provider;
  • email, cloud storage and information technology providers;
  • website security and content delivery providers;
  • podcast hosting and distribution platforms;
  • social media, video and audio platforms;
  • audio, video, photography, transcription, editing and production providers;
  • website designers, developers and other contractors;
  • professional advisers, consultants, insurers and auditors;
  • regulators, courts, tribunals, government authorities and law enforcement agencies; and
  • another person where you consent or where the law permits or requires disclosure.

We take reasonable steps to ensure that service providers only use personal information for authorised purposes and apply appropriate security protections.

Overseas processing and disclosure

Some of the service providers and external platforms that support Tax Talks operate or store information outside Australia.

Personal information may therefore be processed, stored or accessed overseas. Based on our current service providers, those locations are most likely to include the United States and may also include the United Kingdom and countries in the European Union.

The exact location may depend on the provider, the services used and the provider’s technical infrastructure.

Where the Australian Privacy Principles apply to an overseas disclosure, we take reasonable steps to ensure that the recipient handles personal information consistently with those principles, unless an exception applies.

When you independently use an external podcast, video or social media platform, that platform’s own privacy arrangements govern its handling of your information.

Direct marketing and communications

We may send you information about Tax Talks episodes, events or related activities where:

  • you request the information;
  • you subscribe or consent to receiving it;
  • you would reasonably expect us to contact you; or
  • the law otherwise permits the communication.

We will not add you to a marketing list merely because you browse the website.

You may opt out of marketing communications at any time by using the unsubscribe option in the communication or contacting us.

We will not charge you for making an opt-out request.

Security of personal information

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

Our measures may include:

  • secure information technology systems;
  • staff and contractor confidentiality obligations;

No method of internet transmission or electronic storage provides absolute security. You should take care when sending information electronically and avoid sending confidential or highly sensitive information through the general website contact form.

We may retain published podcast episodes, recordings, transcripts, biographies, photographs and promotional materials for an extended period as part of the Tax Talks archive.

We may also retain records relating to guest permissions, publication rights, complaints and disputes for as long as we reasonably need those records.

Accessing your personal information

You may ask us to provide access to personal information that we hold about you.

We may refuse access where the Privacy Act permits us to do so. If we refuse a request, we will generally explain the reason and the available complaint process, unless the law prevents us from providing that explanation.

We do not charge a fee for making an access request. We may charge reasonable administrative costs for providing access where the law permits. We will tell you about any proposed charge before proceeding.

Correcting your personal information

We take reasonable steps to ensure that personal information we use or disclose remains accurate, complete, up to date, relevant and not misleading.

You may ask us to correct or update personal information that we hold about you.

If we refuse a correction request, we will generally explain the reason and the available complaint process.

Changes to this Privacy Policy

We may update this Privacy Policy when Tax Talks, our information-handling practices, our service providers or our legal obligations change.

We will publish the current version on the Tax Talks website and identify the date of the most recent update.
